USER CONTENT POLICY

This User Content Policy, as may be hereafter amended, altered, revised, removed or reinstated howsoever, shall be incorporated as part of the Agreement to govern the relationship between We, as a developer of the Application, and You, as a user, in connection with User Content created, uploaded and/or posted on the Application.

All provisions hereunder shall apply to the extent not contradicted to the Agreement. In the event of contradiction on any part, the provision of this User Content Policy shall prevail.

1. Your User Content

1.1 All information, data, graphics, images, photographs, video and other audio or visual material created, posted and/or uploaded on the Application by You or using Your user account will be deemed You User Content and subject to this User Content Policy.

1.2 By posting Your User Content, You warrant, undertake and agree that:

(a) all User Content are Your original or such content that You retain all rights;

(b) all User Content are lawful and not offensive, obscene, defamatory, abusive, harmful or threatening;

(c) You shall be solely responsible for User Content that You post or upload on to the Application and shall hold harmless of and indemnify Us for any third party claims;  

(d) posting the User Content does not and will not infringe rights of, or be in breach of any obligations against, any person or applicable laws;

(e) You grant Us a perpetual and irrevocable, royalty-free, worldwide and transferable license to copy, reproduce, modify, distribute, publish, broadcast, adapt, translate, transmit, distribute, display through Our Application or websites through which the Application Content may be syndicated either under Our brand name or a third party brand; 

(f) Your User Content may be accessible to other users and third party who will be permitted to share, repost, give opinion and/or make comment on Your User Content and You acknowledge and accept that we have no control or influence over those actions;

(g) You allow Us to use Your User Content in connection with the promotion of the Application and any products or services that We provide to You or otherwise.

2. Removal, Retention and Deletion of Your User Content

2.1 User Content is not routinely moderated by Us but may be reviewed and We reserve the right to edit or remove Your User Content that, in our sole discretion, infringe proprietary right of any person, is inappropriate or otherwise in breach or contradicted to the Agreement or any applicable laws.

2.2 Your User Content may be stored by Us in Our or third party’s database. Upon Your written request to made to Us in accordance with the Complaint Policy, We will delete Your User Content within reasonable time.

3. Complaint

3.1 You may submit a complaint to Us via available method specified in the Complaint Policy requesting removal of User Content posted by other users that infringe Your or others’ proprietary right or in breach of applicable laws in any jurisdiction and We will verify the issue and take reasonable action in due course. In no event shall We be held liable for any infringement or breach or illegality of any User Content and delay in taking action towards the complaint shall not be deemed as Our consent or approval to such infringing User Content.


PRIVACY POLICY 

For the purposes of the Data Protection Act 2018, We, as a data controller, are committed to protecting Your privacy online. Here, We explain how We access, collect, process and manage  Your data; and what controls You have.

This Privacy Policy, as may be hereafter amended, altered, revised, removed or reinstated howsoever, shall be incorporated as part of the Agreement to govern the relationship between We, as a developer of the Application, and You, as a user, in connection with privacy and cookies policy for www.architracker.co and the Application.

All provisions hereunder shall apply to the extent not contradicted to the Agreement. In the event of contradiction on any part, the provision of this Privacy Policy shall prevail.

1. Your Consent

1.1 Upon registration of Your user account, subscription to any services, upload or submit any material via the Application, You consent Us to collect and process the following information about You:

(a) Your personal information (such as Your name, email address, postal address and telephone number) that You provide by completing forms or submission on the Application;

(b) Your information provided in connection with an account sign-in facility, Your password and log-in details;

(c) Your User Content created, uploaded or posted on the Application, including Your comments and opinions given to the Application or User Content of other users;

(d) Your Complaint submitted pursuant to the Complaint Policy;

(e) Your preferences which help us provide You with more tailored offers;

(f) Communications You send Us, for example to report a problem or to submit queries, concerns or comments regarding the Application or its Content;

(g) Information from surveys that We may, from time to time, run on the Application for research purposes, if You choose to respond to them;

(h) Details of Your visits to the Application, the resources You access and any data You download; and

(i) Non-personal data (For purposes of this Privacy Policy, “non-personal data” means “aggregate and de-personalised information, which is data we collect about the use of services of the Application, from which any personally identifiable data has been removed.

1.2 If You enable connection to other applications or services operated by third party service providers, request any information or enter into any competition or promotion We may sponsor, those data collected and stored on such applications or platform may become accessible to Us; and We do not have control over such access.

1.3 We may use tools or third party analytical software to automatically collect and use certain non-personal data that does not directly enable to identify You, including but not limited to: (i) device properties, including IP address, media access control (“MAC”) address and unique device identifier or other device identifier (“UDID”); (ii) device software platform and firmware; (iii) mobile phone carrier; (iv) geographical data such as post code and coarse location; (v) other non-personal data as reasonably required by the Application to enhance our products and services

2. Personal Data

2.1 Upon registration, You will be required to consent Us to access Your Personal Data (as defined in the Data Protection Act 2018) contained on Your device or collected or stored by any third party service providers subject to contractual relationship between You and them or otherwise statue rights, over which We do not have control, including:

(a) Your location;

(b) Your account on Facebook, other social media and email services;

(c) Your personalised preferences;

3. Uses of Your Information

3.1 Your data and information collected pursuant to Section 1 and Section 2 of this Privacy Policy (“Your Information”) will be used without notice to or consent from You to:

(a) help Us to build a profile of Your preferences so We can offer You architectures, building information, events, venues and services that may be of Your interest;

(b) enable Us to process Your orders and provide You with the services and information offered through the Application and which You request;

(c) administer Your user account on the Application;

(d) audit the downloading of data from the Application;

(e) improve the layout and/or content of the pages of the Application and customise them for users;

(f) identify visitors to the Application;

(g) carry out research on Our users’ demographics and tracking of usage data;

(h) share with social networking sites at Your request; and

(i) disclose to lawful authorities when required to do so by applicable laws of any jurisdictions.

3.2 We may also use Your Information for the purposes of contacting You with information or offers regarding upcoming events, products, services or surveys.

4. Public Forum

The Application may, from time to time, make public forums available to its users. Any information that is disclosed in these areas becomes public information and You should exercise caution when using these and never disclose Your personal information.

5. Information Sharing

5.1 Your Information may be shared to Our parent, subsidiary or other related entities who will provide the same or equal protection of user data as stated in this Privacy Policy.

5.2 We may disclose aggregate statistics about visitors to the Application to describe Our services to prospective partners, advertisers, potential merchants and other reputable third parties and for other lawful purposes to the extent that these statistics will not include personally identifiable information to You. 

5.3 In the event that We undergo merger or business transfer, You agree that Your Information may be transferred to that merger entity or buyer.

5.4 We may disclose Your Information if (i) We required to do so by law; (ii) We believe that such action is necessary to prevent fraud or cybercrime or to protect the Application or to enforce the terms under which You transact with Us or to enforce the rights, property or personal safety of any Person.

6. External Links

The Application may, from time to time, contain links to external sites. You shall proceed to those links on Your own decision; and You acknowledge and accept that We do not have control over and are not and cannot be responsible for policies on data privacy of those sites.

7. Third Party Service Providers

Your Information may be collected, stored and processed by third party service providers who provide services that You opt to procure on the Application such as payment gateway service provider. You acknowledge and accept that We do not have control over and are not and cannot be responsible for policies on data privacy of those service providers.

8. Marketing to You

We may send You information We think You may find useful or which You have requested from Us by push notification and/or (if You provide Us with your e-mail address) by e-mail, including information about the latest or upcoming events featured on the Application, provided that You have indicated that You do not object to being contacted for these purposes.

9. Your Location Data

In order to get the most out of the Application and to allow Us to provide You with tailored offers, We need to process Your approximate location from time to time. The types of location data that will be processed are your latitude, longitude, cell tower ID, etc. Your location data will only be processed for as long as necessary in order for Us to respond to Your request for tailored offers. After this the data will be deleted. The location data may be transferred to Our merchants for the purpose of providing You with the best offers at that time to match Your preferences.

10. Security

We place great importance on the security of all personally identifiable information associated with our users. We have security measures in place to attempt to protect against the loss, misuse and alteration of personal information under Our control. For example, Our security and privacy policies are periodically reviewed and enhanced as necessary; and only authorised personnel will have access to personal information. Although We use all reasonable efforts to protect Your information, You should bear in mind that submission of information over the internet is never entirely secure. We cannot guarantee the security of information You submit via the Application whilst it is in transit over the internet and any such submission is at Your own risk.

11. Storage of Your Information

Your Information is sent to and stored on secure servers located in the United Kingdom and other European Economic Area countries. This is necessary in order to process the information. Information submitted by You may be transferred by Us to Our other offices and/or to the third parties mentioned in the circumstances described above, which may be situated outside the European Economic Area and may be processed by staff operating outside the European Economic Area. By submitting information via the Application, You agree to this storing, processing and/or transfer.

12. Your Rights

You have a legal right under the Data Protection Act 2018 to a copy of all the personal information about You held by Us. On request, We will provide You with a copy of this information subject to a fee not exceeding £10. You also have a right to correct any errors in that information.

13. Your Controls

13.1 You may at any time disable access to any of Your Information by changing the settings on Your device or disabling connection of the Application to those third party applications or services or by contacting Us using contact details at the end of this Privacy Policy.

13.2 You may opt-out of receiving further e-mails or push notifications by following the unsubscribe instructions on any communications sent to You. You can also exercise this right at any time by contacting Us using the contact details at the end of the Privacy Policy.

13.3 Please note that if You choose not to allow Us to process Your location data, We will not have enough data in order to provide You with the full benefit of Our service (e.g. a list of tailored offers matched to Your approximate location).


COPYRIGHT POLICY

This Copyright Policy, as may be hereafter amended, altered, revised, removed or reinstated howsoever, shall be incorporated as part of the Agreement to govern the relationship between We, as a developer of the Application, and You, as a user, in connection with the Intellectual Property Right associated with the Application, Content, User Content on the Application.

All provisions hereunder shall apply to the extent not contradicted to the Agreement. In the event of contradiction on any part, the provision of the Copyright Policy shall prevail.

1. Content on Application

1.1 All Content on the Application are copyrighted and any intellectual property or other proprietary thereof or related thereto including but not limited to rights associated with business names, trademarks, trade names, logo, design, codes, domain names, databases whether registered or unregistered, existing now, in the future, and anywhere in the world (“Intellectual Property Rights”) belong to Us or Our licensor.

1.2 You further acknowledge and agree that the Content may be subject to third party ownership or proprietary right and You may be bound by terms of use stipulated by such third party or any relevant laws, of which We are not responsible to inform You.

1.3 You are allowed to use the Content for Your personal purpose to enjoy services of the Application only.

1.4 Except for User Content that You create, upload and/or post Yourself as allowed pursuant to this Agreement, You have no title, right or interest (and no Intellectual Property Rights are transferred to You) in relation to this Application and/or any Content thereon. Except where expressly referred to in tis Agreement, You are prohibited from copying, modifying, distributing, broadcasting, sharing or making publicly available, renting, lending, republishing, framing, providing links to or uploading any parts of the Application and/or Content. Furthermore, You are strictly prohibited from seeking to commercially exploit any Content or reproduce it in connection with any service that You provide without Our prior written consent. As a user, You may however post ‘likes’ or share/link to Content through Your Facebook account, other social media and email services.

2. User Content

2.1 Copyright and any other proprietary rights associated with Your User Content shall belong to You.

2.2 You grant Us a perpetual and irrevocable, royalty-free, worldwide and transferable license to copy, reproduce, modify, distribute, publish, broadcast, adapt, translate, transmit, distribute, display through Our Application or websites through which the Application Content may be syndicated either under Our brand name or a third party brand.
